15.Electronic document dispatch and export control

15.1
The customer agrees that documents relevant to his order (e.g., order confirmation, delivery note, invoice) will be transmitted to him by e-mail or in other suitable electronic form. All transmissions to the e-mail or other electronic address provided by the customer shall be deemed to have been received by the customer upon dispatch.

15.2
If the customer places an order digitally via the GM platform, all documents relating to the order in the "Booked Orders, Delivery Tracking and Liabilities" section will be stored electronically.

15.3
The delivery or export of the goods by GM may be subject to sanctions or other applicable export control rules that could be interpreted by competent authorities or courts that this prohibits or limits the performance of the contract or is subject to approval by competent authorities. The assessment of such sanctions or other applicable export control rules shall be at GM’s discretion. GM’s liability for the proper exercise of this discretion is excluded. If the performance of the contract on the part of GM should cause sanctions or violate applicable export control regulations that affect the customer, GM is again excluded from liability in this respect. GM reserves the right to unilaterally cancel orders without being liable to the customer for any damage or loss arising from or in connection with such cancellation, if a necessary authorization is revoked or not granted, or if the contract is suspended and/or terminated if its performance is the result of embargoes, sanctions or similar trade or export restrictions (in any case, including US sanctions, insofar as their observance would not be legally impermissible under European law)- regardless of whether these were foreseeable or not at the time of conclusion of the contract - is hindered or made more difficult in an unreasonable manner.

16. Data protection and data security

16.1
Any data transmitted to GM in the context of the contractual relationship is subject to the Data Protection Policy (GDPR), and must be handled in accordance with this Data Protection Policy.

 

16.2

The customer is obliged to comply with all relevant current and future data protection regulations. The customer is also obliged to transfer these obligations to his employees and any commissioned third parties. In this context, GM assumes no liability for any violations of relevant data protection regulations by the customer.

 

16.3

The customer ensures and assumes the responsibility that personal data, for which the customer as the controller within the meaning of Art. 4 No. 7 GDPR applies, may be lawfully transmitted to GM and there are no indications that the processing by GM is inadmissible to the foreseeable extent and for the foreseeable purposes. The customer will ensure that the data subjects are informed about the processing by GM to the extent required by law.

 

16.4

The customer shall ensure the confidentiality, integrity, security and accuracy of all personal data received and processed by GM.
